Welcome to CSS ASSETS MANAGEMENT, LLC. This document including the sections below and all sub-sections constitutes your agreement with us. Please read it carefully before using https://www.cssassets.com or our mobile application (collectively referred to as the “Online Services”).

Throughout these Terms of Use, our company is referred to as "CSS ASSETS MANAGEMENT, LLC," "we," "us," or "our." You, the user, are referred to as "you" or "your."

B. Binding Contract & Emphasis of Important Provisions

By visiting www.cssassetsm.com or using any CSS ASSETS MANAGEMENT, LLC mobile application, you are entering into a legally binding agreement with us. If you do not agree to these Terms, do not use our Online Services.

If you represent an entity, you must have authority to bind that entity to these Terms. Otherwise, you may not use our Services.

We reserve the right to modify these Terms or discontinue any part of the Online Services at any time. Continued use after modifications constitutes acceptance.

Important Legal Notices: This agreement contains an Arbitration Clause and Class Action Waiver. By agreeing, you waive your right to participate in a class action lawsuit or class-wide arbitration.

About Our Services

CSSAM provides an online platform for rental listings, property management, and discovery of real estate. Our Online Services originate from the United States. Users outside the U.S. are responsible for compliance with local laws.

C. Eligibility

You must be at least 18 years old to use our Services. You warrant that you have the legal right and capacity to enter this agreement. Automated use (bots, scripts, etc.) is prohibited.

D. What You Get From This Agreement

You are granted a limited, non-exclusive license to use our Online Services for personal use. CSSAM retains ownership of all intellectual property related to the Services.

You may close your account anytime by contacting info@cssassets.com.

E. Your Obligations

• Comply with all applicable laws and regulations.
• Exercise independent judgment when dealing with others via our platform.
• Acknowledge that we are not responsible for third-party listings or information.
• Understand that we are not a party to agreements made between users.
• Refrain from using the platform for unlawful or misleading purposes.

F. Restrictions on Use

• Do not infringe on intellectual property rights.
• Do not post false, discriminatory, or illegal content.
• Do not upload malware, spam, or offensive materials.
• Do not attempt unauthorized access or reverse-engineering.
• Do not assist others in violating these Terms.

G. Violation of Terms

We may disclose your information if required by law or to protect rights, property, or safety. We may retain communications if necessary to enforce these Terms or respond to claims.

H. Termination

We may suspend or terminate your access without notice for violations. Upon termination, access will be revoked, and user data may be deleted. Some provisions (like indemnification) will survive termination.

I. Limitation of Liability

To the fullest extent permitted by law, CSSAM and its affiliates are not liable for:

• User submissions or third-party actions.
• Indirect, punitive, or consequential damages.
• Lost profits, data, or unauthorized access.

Maximum direct damages are limited to $50 USD.

J. Indemnification

You agree to indemnify and hold harmless CSSAM, its affiliates, and representatives from any claims or costs arising from your misuse, content, or violations of these Terms.

K. Arbitration

All disputes shall be resolved by binding, individual arbitration under the American Arbitration Association’s Consumer Arbitration Rules. You waive the right to a jury trial. Claims may be filed in Small Claims Court in Kings County, NY.

L. Waiver of Class Action Participation

You waive participation in class actions, class-wide arbitrations, or private attorney general claims. Arbitration will follow the Federal Arbitration Act and applicable state laws.
